Terms of Service
These Terms of Service (“Terms”) govern access to and use of the Storklers mobile application, websites, and related services (the “Service”) operated by Avolox LLC (“Storklers,” “we,” “us,” or “our”). By creating an account, paying fees, or using the Service, you (“you” or “User”) agree to these Terms.
1. Definitions
“Traveler” means a user who publishes or maintains a trip or route listing to coordinate potential carriage of items.
“Requester” means a user who publishes or maintains a connection request or delivery request for an item.
“Listing” means a Trip Listing or Delivery Request (or equivalent feature labeled in the app) that you seek to publish on the Service.
“Platform Fee” means the service fee Storklers charges for certain actions in the app, as displayed at checkout before a Listing is published or activated.
“Contract of Delivery” means any agreement about items, reimbursement, handoff, or transport between users. Storklers is not a party to the Contract of Delivery.
2. The Service Is a Technology Venue Only
2.1 Platform only.
Storklers provides a digital venue for independent users to exchange information and to coordinate potential peer-to-peer deliveries. We do not ourselves transport goods.
2.2 Not a carrier or agent.
Storklers is not a courier, freight forwarder, customs broker, insurer, warehouse, or bailment holder. Storklers does not take title to, possession of, or control over any item. Any obligation to buy, carry, declare, insure, or deliver items exists only between users, unless expressly stated otherwise in a separate written agreement between you and another user (not Storklers).
2.3 No employment.
Nothing in these Terms creates an employment, agency, or partnership relationship between Storklers and any user, or between users.
3. Eligibility and Accounts
3.1 Binding agreement.
You represent that you have the legal capacity to enter these Terms. If you are under the age of majority in your jurisdiction, you may use the Service only as permitted by applicable law, including any requirement for parental or guardian consent and supervision. Storklers may set or enforce minimum ages or verification requirements for certain features (including identity verification) where required by law or by our verification providers.
3.2 Account security.
You are responsible for credentials and activity under your account. You must provide accurate information and keep it updated.
3.3 Suspension.
We may suspend or terminate accounts that violate these Terms, create risk, or are required by law or payment partners.
4. Platform Fees, Billing, Refunds, and Payments Between Users
4.1 What the Platform Fee covers.
Storklers charges Platform Fees for use of certain Service features, including creating or publishing a Listing, as shown in the app at checkout. The Platform Fee compensates Storklers for access to the marketplace and related coordination tools (including in-app messaging features made available in connection with your Listing). The Platform Fee is not a payment for goods, freight, insurance, customs services, or guarantee of any outcome.
4.2 When fees are charged.
Platform Fees become due at checkout when you confirm payment for the applicable Listing feature. Listing publication or activation may depend on successful payment, as implemented in the app. Payment does not guarantee any match, message, response time, successful delivery, or any particular conduct by another user.
4.3 Payment processing.
Payments are processed by third-party payment processors (for example, card payments processed by our payment partners). You authorize Storklers and its payment processors to charge your selected payment method for amounts shown at checkout, including applicable taxes if displayed.
4.4 Taxes.
You are responsible for taxes imposed on Platform Fees as required by applicable law, as presented at checkout where applicable.
4.5 Fee changes.
Storklers may change Platform Fees prospectively for new checkouts after reasonable notice (for example, by in-app notice or by updating these Terms).
4.6 Refunds.
Except where refund rights are required by applicable law, Platform Fees are final and non-refundable, including if you do not receive matches, messages, or deliveries; if another user cancels; if you stop using the Service; or if you are dissatisfied with any interaction.
4.7 Platform escrow and payments outside Storklers
Where the Storklers application makes available payment on the platform, authorized third-party payment service providers (for example, licensed payment processors) alone carry out processing, authorization, capture, settlement, and disbursement of funds, and may hold funds only as permitted under their agreements, applicable law, and the disclosures presented at checkout. Storklers is not a bank, money transmitter, or custodian of user funds; its role is to provide the marketplace and access to those provider-operated flows, subject to these Terms.
In-app safeguarded payment features apply only to transactions completed through those provider-mediated flows. They do not apply to funds that users send directly to one another outside the Storklers application (including cash, bank transfers, or third-party payment applications), unless we expressly state otherwise in writing.
Unless and until a payment for goods between a Traveler and a Requester is expressly completed through an eligible in-app checkout flow operated by our payment service providers as described above, that payment, reimbursement, or price occurs outside Storklers at the parties’ sole risk, subject to applicable law and these Terms.
Timing, settlement, reversals, currency conversion, and fees are determined by the relevant payment providers, payment networks, and banks, and may depend on listing type and the specific flow presented at checkout. If funds are paid out in a currency other than the currency in which a charge was authorized, the final received amount may differ due to conversion and fees from those providers or banks.
4.8 Non-circumvention.
Users shall not use the Service to systematically bypass Platform Fees where a fee has been established for a paid Service feature, or to arrange fees in a way that defrauds Storklers, users, or payment partners.
5. Identity Verification (KYC) and Disclaimers
5.1 Verification may be required.
Access to certain features may require identity verification (which may include government-issued identification and biometric checks performed by third-party vendors).
5.2 No warranty of character.
Verification aims to help confirm certain identity information according to the vendor’s process. It does not guarantee a user’s honesty, reliability, financial standing, or lawful behavior. Verification is a risk-reduction tool, not an endorsement.
6. Prohibited Uses and Items
6.1 Prohibited conduct.
You will not use the Service for unlawful activity, fraud, harassment, hate, exploitation, or to coordinate illegal transport.
6.2 Prohibited items (non-exhaustive).
Users must not request or transport items including, where unlawful without proper authorization:
- controlled substances, narcotics, or prescription medication without valid cross-border permits;
- counterfeit goods or goods that infringe intellectual property;
- currency or negotiable instruments where restricted;
- dual-use technology or other items restricted by export, sanctions, or trade controls.
You are solely responsible for legality in origin, transit, and destination jurisdictions.
7. Customs, Import/Export, and Compliance
7.1 User duties.
Travelers and Requesters are solely responsible for lawful declarations, duties, taxes, licenses, and compliance with customs and border laws (including, where relevant, any other applicable international trade or sanctions rules).
7.2 No reliance on Storklers.
Storklers does not provide customs or legal advice. Storklers is not liable for seizure, fines, delays, or penalties arising from user non-compliance, mis-declaration, or under-valuation.
7.3 Indemnity (customs/trade).
To the fullest extent permitted by law, you agree to indemnify and hold harmless Storklers from claims, fines, penalties, and reasonable legal costs arising from your violation of customs, import/export, sanctions, or related laws in connection with your use of the Service.
8. Mandatory Inspection and Contents Verification
8.1 Traveler inspection.
Where applicable to your arrangement, Travelers should open and inspect packages when reasonably possible and verify that contents match the Requester’s stated request and appear lawful.
8.2 Acceptance of risk after inspection.
If a Traveler proceeds after inspection, the Traveler acknowledges they are proceeding based on their own satisfaction regarding legality and condition, subject to any separate agreement between users.
8.3 Storklers not liable for user disputes.
Storklers is not liable for discrepancies, concealment, or disputes between users regarding items.
9. Proof of Purchase and Receipt Transparency
9.1 Receipt uploads where required.
If the Service requires receipt images or purchase documentation, users must follow in-app instructions. Failure to provide required documentation may breach user-to-user expectations and may lead to platform sanctions.
9.2 Authenticity.
Users are responsible for the accuracy of uploaded documents. Receipts may be relevant for customs valuation as between users and authorities; Storklers does not guarantee acceptance by any government agency.
10. Packaging: “With Box” vs “Without Box”
10.1 User election.
Packaging preferences are agreed between users where the Service allows selection.
10.2 Customs implications.
Users acknowledge that packaging choices may affect customs treatment. Users accept legal consequences of their declarations and agreements.
10.3 Damage assumptions.
Where “Without Box” is chosen, users may allocate risk of minor cosmetic wear between themselves. Storklers is not a party to that allocation.
10.4 Capacity.
Travelers may decline requests that exceed reasonable luggage constraints if communicated between users in line with marketplace norms.
11. Messaging and Monitoring
11.1 No unlawful instructions.
Messaging must not be used to arrange illegal activity, evade law enforcement, or launder money.
11.2 Enforcement.
Storklers may use technical and policy measures (including review where legally permitted) to enforce these Terms and protect users and partners.
12. Intellectual Property
The Service, branding, and content provided by Storklers are protected by intellectual property laws. You receive a limited, revocable license to use the Service according to these Terms.
13. Disclaimers
13.1 As-is.
The Service is provided “as is” and “as available” without warranties of any kind, except where prohibited by law.
13.2 Third parties.
Storklers does not control users and does not guarantee any transaction between users.
14. Limitation of Liability
To the fullest extent permitted by law, Storklers’ total liability for any claim arising out of these Terms or the Service shall not exceed the greater of:
- (a) the Platform Fees you paid to Storklers in the twelve (12) months before the claim; or
- (b) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow certain limitations; in those jurisdictions, Storklers’ liability is limited to the maximum permitted by law.
15. Indemnification
You agree to indemnify and hold harmless Storklers and its affiliates, officers, and employees from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your Listing, your items, your breach of these Terms, or your violation of law—except to the extent caused by Storklers’ willful misconduct or gross negligence (if applicable law permits such qualification).
16. Dispute Resolution
16.1 Governing law.
These Terms are governed by the laws of the State of Texas, United States, excluding conflict-of-law rules that would apply another jurisdiction’s law.
16.2 Arbitration / courts.
Except where prohibited by applicable law, you and Storklers agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state courts of Texas sitting in Potter County, Texas (Amarillo) and the United States District Court for the Northern District of Texas, Amarillo Division, and you consent to personal jurisdiction and venue in those courts.
Consumer rights that cannot be waived under mandatory local laws remain unaffected.
16.3 Informal resolution.
Before filing a claim, you agree to contact Storklers at hello@storklers.com to attempt informal resolution.
17. Changes to These Terms
We may modify these Terms. We will provide notice as required by law. Material changes may require renewed acceptance in the app. Continued use after the effective date of changes may constitute acceptance where permitted by law.
18. Miscellaneous
18.1 Severability.
If a provision is invalid, the remainder remains in effect.
18.2 Assignment.
Storklers may assign these Terms. You may not assign without our consent.
18.3 Entire agreement.
These Terms (and policies referenced by link) are the entire agreement regarding the Service.
18.4 No waiver.
Failure to enforce a provision is not a waiver.
19. Privacy
Your personal data is processed as described in the Storklers Privacy Policy, which is incorporated by reference.
